Arbitration will be conducted by a single, neutral arbitrator. The arbitrator shall have exclusive authority to resolve all disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this agreement is void or voidable. The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

The governing law for this arbitration agreement and for any Dispute shall be the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding in support of arbitration, including to compel arbitration or to confirm, modify, or vacate an award, must be brought exclusively in the state or federal courts located in or nearest to Sarasota, Florida, and the parties hereby consent to the jurisdiction and venue of such courts for these purposes.
This arbitration agreement does not prevent either party from seeking remedies in small claims court for disputes or claims within that court’s jurisdiction. The parties also retain the right to seek provisional remedies or injunctive relief from a court of competent jurisdiction as necessary to protect their rights pending completion of arbitration.
